1. Acceptance of Terms

By accessing and using the services provided by Mindwell Therapy Collective ("the Company," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services. Your continued use of our services constitutes your acceptance of these terms and any modifications we may make from time to time.

2. Service Description

Mindwell Therapy Collective provides mental health and wellness services through licensed therapists and counselors. Our services are delivered through virtual consultations, assessments, therapeutic sessions, and related wellness support. Services are provided for informational and therapeutic purposes and do not replace emergency medical care or crisis intervention services.

In the event of a mental health crisis or emergency, please contact emergency services or visit your nearest emergency department immediately.

3. User Obligations

As a user of our services, you agree to:

  • Provide accurate and complete information when registering and during consultations
  • Maintain the confidentiality of your account credentials and login information
  • Use our services only for their intended purposes and in compliance with applicable laws
  • Treat our therapists and staff with respect and professionalism
  • Not engage in any form of harassment, abuse, or inappropriate conduct
  • Not attempt to access or use services on behalf of another person without authorization
  • Comply with all applicable federal, provincial, and local laws and regulations
  • Notify us immediately of any unauthorized access to your account

4. Intellectual Property Rights

All content on the Mindwell Therapy Collective platform, including but not limited to text, graphics, logos, images, audio, video, and software, is the property of Mindwell Therapy Collective or its content suppliers and is protected by international copyright laws.

You are granted a limited, non-exclusive, non-transferable license to access and use our services for personal, non-commercial purposes. You may not reproduce, distribute, modify, transmit, display, perform, or publish any content from our platform without prior written permission from Mindwell Therapy Collective.

All materials provided by our therapists during sessions, including treatment plans, notes, and recommendations, remain the intellectual property of Mindwell Therapy Collective and are provided solely for your personal therapeutic benefit.

5. Limitation of Liability

To the fullest extent permitted by law, Mindwell Therapy Collective shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, even if advised of the possibility of such damages.

Our services are provided on an "as-is" basis without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

Your use of our services is entirely at your own risk. Mindwell Therapy Collective shall not be liable for any interruptions, delays, or errors in service delivery, including those due to technical issues, internet connectivity, or server outages.

The therapist-client relationship established through our services is professional and therapeutic in nature. Mindwell Therapy Collective and its therapists are not liable for outcomes resulting from user decisions made outside of our professional advice.

6. Confidentiality and Privacy

The confidentiality of your therapeutic information is paramount. Mindwell Therapy Collective adheres to all applicable privacy legislation, including the Personal Information Protection and Electronic Documents Act (PIPEDA) and provincial privacy laws.

Information disclosed during therapy sessions is protected and will not be shared without your explicit written consent, except where required by law, such as in cases of imminent danger to yourself or others, child abuse, or other legal obligations.

7. Payment and Fees

You agree to pay all fees as quoted and agreed upon for services rendered. Payment terms and methods will be clearly communicated prior to service initiation.

Fees are non-refundable once services have been rendered, except where otherwise specified in writing. Cancellations must be made at least 24 hours in advance to avoid being charged for the session.

Mindwell Therapy Collective reserves the right to suspend services if payment is not received by the agreed-upon date.

8. Termination of Services

Mindwell Therapy Collective reserves the right to terminate or suspend your access to our services at any time, with or without cause, and with or without notice. This includes situations where you violate these Terms of Service, engage in abusive or threatening behavior, or otherwise compromise the therapeutic relationship.

If we terminate services, we will provide appropriate referrals and transition support as professionally appropriate.

9. Modifications to Terms

Mindwell Therapy Collective reserves the right to modify these Terms of Service at any time. Modifications will be effective immediately upon posting to our website or application. Your continued use of our services following the posting of revised terms constitutes your acceptance of the changes.

10. Governing Law and Jurisdiction

These Terms of Service are governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law principles.

You agree to submit to the exclusive jurisdiction of the courts located in Ontario for the resolution of any disputes arising from or related to these Terms of Service or the use of our services.

12. Severability

If any provision of these Terms of Service is found to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if such modification is not possible, the provision shall be severed. The remaining provisions shall remain in full force and effect.

13. Entire Agreement

These Terms of Service, together with our Privacy Policy and any other agreements you have entered into with Mindwell Therapy Collective, constitute the entire agreement between you and the Company regarding the use of our services and supersede all prior and contemporaneous agreements, understandings, and negotiations.
